UPDATE, MY SON JAMES IS GRAVELY ILL

  

UPDATE: JAMES MARSHALL HAS METASTATIC CANCER SPREAD TO THE LUNG. He will have surgery this week.
Also, his teeth cannot be saved. For years the HERO property tax scam and Petersen Dean’s Case BC661819 blocked our access to the equity in our house and stopped us from being able to cap James’s teeth and destroyed us financially. James will have no teeth to chew with as he tries to recover from cancer in a gutted house. Because of his autism he can’t wear false teeth. He is so weak he has to sit everywhere he goes. His life has been cut short by these horrible financial crimes. We must file criminal charges. Some Los Angeles County employees have done the opposite of their duty to protect consumers and have protected HERO / Renovate America instead. This must be investigated and all parties who participated in the financial fraud must be brought to justice. I begged HERO and PETERSEN DEAN for my son’s life many times in writing. I asked LA County to investigate HERO and they shelved my official complaint and told me they could help me and my son transition into a homeless shelter. They told me not to go after HERO. They refused to accept documentation that would incriminate HERO.
My son and I fought alone,  in pro per for our home because LA County would not help us and told us to give up and just let HERO’S contractor take our home. Everyone who profited from this property tax financing home repair scam must be brought to justice. They have destroyed a lot of lives and they will destroy more. I see my son suffer every minute of every day and night. Greedy people could not resist the temptation to steal, cheat and lie. They didn’t care if it killed James. HERO, Petersen Dean and some LA County employees loved money more than life and were willing to kill for it. Every step of the way I cried out that James was sick and getting sicker because of the horrible things HERO and PETERSEN DEAN were putting us through to cover up their property tax scam. The trial by jury was set for April 2019 but Petersen Dean dismissed their case to avoid the jury from seeing what they did to James to try cover up their home repair scam.
 

OPEN LETTER TO CAP SPECIALTY: WHEN COLLATERAL DAMAGE BECOMES MURDER

Dear Cap Specialty,

I filed a claim with you when your client PETERSEN DEAN first began destroying our lives.

As the months and years go by since 2016 and the health of my autistic son JAMES MARSHALL continues to decline, it can no longer be possible for you or your client PETERSEN DEAN and their partner RENOVATE AMERICA to claim ignorance regarding what their illegal use of MECHANICS LIENS  has caused and is causing in the way of collateral damage.

My autistic son is losing teeth because of illegally filed MECHANICS LIENS. You told me you would just wait and see what the courts rule before you take any action regarding your client PETERSEN DEAN.

It wasn't enough for you when the CSLB placed a CITATION on PETERSEN DEAN'S license for five years.

It wasn't enough for you when Judge Murphy allowed a trial by jury after PETERSEN DEAN fought for months to deny me a trial by jury.  It wasn't enough for CAP SPECIALTY when the court refused to allow PETERSEN DEAN to strike my answer to their very shady case filings.

A reasonable person can easily read and understand that PETERSEN DEAN failed to meet the very clear and easy to understand requirements for filing MECHANICS LIENS.

A reasonable person can read my son's dental records and see that if the money to cap all JAMES MARSHALL'S teeth is being blocked by PETERSEN DEAN'S illegal use of MECHANICS LIENS, that all of JAMES'S teeth must be pulled to save his life, that JAMES MARSHALL could die the longer the surgeries planned for in 2016 are blocked by PETERSEN DEAN and RENOVATE AMERICA and CAP SPECIALTY. James is not a candidate for false teeth due to his autism.

JAMES MARSHALL will no longer be able to chew food if all his teeth are pulled because of PETERSEN DEAN and HERO/RENOVATE AMERICA'S property tax financing scam being interrupted by H&R Block informing me it was a scam and PETERSEN DEAN deciding to renege on the promise to remove the solar panels and make repairs the CSLB Citation proves PETERSEN DEAN never made. PETERSEN DEAN tried to outrun justice by illegal use of MECHANICS LIENS to snatch the property before anyone could discover the shady financing.

(PETERSEN DEAN put nice new shingles on top of rotten wood. Termite drippings from that rotten wood are filling up our house because this rotten wood was left there instead of being removed. A reasonable person does not get $34,000 in debt they can't afford in order to own a massive amount of solar panels they can't afford to use with rotten wood underneath the panels, underneath the new shingles. None of this passes the reasonable person test.)

CAP SPECIALTY has been aware that my autistic son JAMES MARSHALL could die, loose all his teeth or both horrible fates because of the actions of their client PETERSEN DEAN. 

Like RENOVATE AMERICA/HERO FINANCING, CAP SPECIALTY also told me they want to "wait and see" how PETERSEN DEAN does in their case BC661819. 

CAP SPECIALTY informed me that they prefer to wait and see if PETERSEN DEAN gets lucky and gets away with it. 

You told me this, CAP SPECIALTY. RENOVATE AMERICA has a responsibility to stop their contractors but they told me the same thing you did, they will wait and see if their contractor manages to get away with this. You both told me your actions would not be based on right and wrong, but only on if PETERSEN DEAN gets caught or not. You both know PETERSEN DEAN broke the law but you both know that because my son and I are alone in court, that I am still "in pro per,  you have hope of escaping liability because of technicalities, fatal clerical errors I might make, because I don't know how to do legal work.

It will be pointed out to the jury that both CAP SPECIALTY and RENOVATE AMERICA/HERO knew PETERSEN DEAN was guilty of financial fraud, illegal use of MECHANICS LIENS and both CAP SPECIALTY and RENOVATE AMERICA/HERO decided to roll the dice to see if PETERSEN DEAN got away with the crimes even if the COLLATERAL DAMAGES INCLUDED THE DEATH OF JAMES MARSHALL.

I urge CAP SPECIALTY to reconsider their position on the circumstances created by their client PETERSEN DEAN which endanger the life of JAMES MARSHALL. If CAP SPECIALTY decides to wait until APRIL 2019 to see if PETERSEN DEAN gets away with crimes, CAP SPECIALTY is also guilty of those crimes and additional crimes of covering up crimes.

James cried so long this morning and could not eat breakfast. I gave him an ALEVE tablet and dipped a tiny soft toothbrush in ANBESOL to coat and sooth the exposed nerves. PETERSEN DEAN fought hard to deny us a trial by jury so a jury would never hear what they put James through to hide their financial fraud.

Dear Ms Bell, 

The judge in case BC661819 wanted me to talk to Petersen Dean’s Attorney. George Milionis never returns my calls. I assume he told you to make this inappropriate offer. This action suggested by you would cover up the HERO and PETERSEN DEAN financial fraud.

The job in question was never properly finished, the solar panels were never turned on because we all agreed they needed to be removed because it was a tax credit scam. 

Petersen Dean and HERO agreed to remove the solar panels when HRBlock reviewed the documents and determined the figures were padded and I would not save one penny by going solar. In fact, I would be in severe, crippling debt till I was 88 years old. No one in their right mind would go solar to get in severe debt. I was told I would save money but that was a bold lie, a blatant tax credit scam.

This rough estimate given to Cap Specialty will help you begin to calculate our ongoing loss. What Petersen Dean has done to my autistic son has caused him permanent physical and psychological damage. That has not been calculated and is ongoing. A court will determine it. 

It is inappropriate to keep making a shell game of the financing. Petersen Dean’s idea of financing is not like that of any business i have ever seen or heard of. The mafia “finances” this way, changing terms out of the blue and bullying people. We have been living in hell since November 2, 2016. Petersen Dean has held us in excruciating limbo every moment  of every night and day since. Petersen Dean took our lives away. Petersen Dean needs to make us whole again as much as that is possible. It is like being a prisoner of war. You cannot image how much this hurts unless someone does it to you. The pain could not be worse if a serial killer had kept us in a pit since November 2, 2016. My son and I will never fully recover. My son is hurt physically and mentally because of Petersen Dean’s and HERO’s crime spree.

Due to my financial circumstances I ONLY qualified for HERO financing. The CFPB has documentation of this fact as do the three credit bureaus. I NEVER applied for any other type of financing. Petersen Dean cannot change that reality. 

I had HERO financing and Petersen Dean violated the terms of the HERO Program. You need to contact HERO and pick up where you left off and do the right thing, calculate all our loss and cover it. There is not a legitimate business in the would that does this bait and switch type financing. That is criminal. 

There is a legal case BC661819 and there is an open case with the CSLB. CSLB SF 2016 9935. My financing was with HERO. It was illegal to revoke my financing. Also, the Attorney General will be reviewing the matter and I will probably be called testify to my ongoing losses caused by Petersen Dean. It would be more appropriate for Petersen Dean’s Attorney to contact me as the judge suggested. It is not appropriate to keep trying to conceal the HERO financing simply to cover up that it clearly was a tax credit scam. It is unpleasant for Petersen Dean and HERO to deal with the reality of being caught attempting to get away with a tax credit scam, but attempting to cover up that crime is just adding more layers of crime. Bullying the victims is also criminal. It is time to stop torturing us and do the right thing.
